Title: The TikTok Ban Debate: Balancing Security and Freedom of Expression

Introduction

Tik Tok, known by Zoomers as the major social media platform that carries short video

content, has now been put under the spotlight as the latest focal point of the American political

arena nowadays. The company ByteDance, with its high rate of growth, notably among younger

demographics, causes concern among the public in relation to ownership of this product. This kind

of dominance has raised concerns about whether the Chinese government could get Chinese

people's information through Byte Dance, which raises questions about privacy and national

security. In this article, different decisions that can be made regarding the activity of TikTok are

analyzed. This explores their own arguments as well as the intent of the opponents of the

application, proving that the security issues are indeed real, but freedom of speech, which should

be one of the foundation stones of any democratic society, should not be undermined by a complete

ban.

Any investigation of the mixed opinions on the TikTok band issue will not be complete

without taking into consideration the different views offered by different amendments. Fung, Brian, in his

article for CNN Business, introduces lawmakers' growth in issues concerning TikTok's security threats. Drawing

from her research, Anotita Kwande's article puts forward the arguments about the pressures on

freedom of speech that stem from a TikTok ban (Kwande). These provide the necessary ammunition to prove

either the ban or the non-ban case, and for both sides of the divide, the arguments are reliably based on these sources.

Security Concerns: The TikTok supporters are saying that TikTok is an app that carries a

highly challenging danger. There are numerous verdicts when it comes to China's actions involving

TikTok's security threats. Drawing from her research, Anotita Kwande's article puts forward the

arguments about the pressures on freedom of speech that stem from a TikTok ban (Kwande). These

provide the necessary ammunition to prove either the ban or the non-ban case, and for both sides

of the divide, the arguments are reliably based on these sources.

non-Chinese-owned companies that perhaps stole or spied on data. Fung covers the fact that the

U.S. lawmakers regard TikTok as a security threat because of its China origins and that the Chinese

state can use the platform as an instrument of espionage (Fung).

Freedom of Expression: The other side, moreover, argues that freedom of speech

provided in the First Amendment would be violated if the ban were put in place. Kwande dissects

the possible consequences of the banning of TikTok for the freedom of speech, demonstrating how

the authoritarian governments have the tendency of extending censorship to the online space.

Balanced Approach: In order to tackle these problems taking into account all aspects is

important. Though raising security concerns is justifiable, absolute prohibition of TikTok is not

the best of remedies. Other options to safeguard users data were available, working toward

increased transparency and overseeing TikTok's data practices could be recommended.

Counterargument

Others can arise from fears of TikTok with a higher risk of data breaches and intelligence,

these risks will simply exceed the value of freedom of expression (Fung, 2023). Implementation

of restrictions on TikTok could lead to a situation where users move from one platform to another

while they present the same danger. A ban is not the solution. If instead, more stringent regulations

and monitoring mechanisms to secure freedom of expression are in place, fewer security threats can be mitigated. Moreover, banning a single app like TikTok completely could be the beginning of a dangerous scenario where the censorship of other online content would be a possibility, which might restrict other fundamental rights. Consequently, finding a compromise that guarantees security without allaying the fears of privacy is the demand of the hour.

Counterargument 1: Security Risks vs. Freedom of Expression

Some suggest freedom of expression is of no significance in the light of TikTok’s security concerns (Fung, 2023). They claim that protecting national security should be more of a priority than keeping the platform for creative expression.

Rebuttal 1:

While the security threats from TikTok are real, it is not necessary to modify the platform as the total ban from use might not be effective (Kwande, 2023). Rather than banning such cars, which is drastic, adopting stringent regulations and monitoring systems might be a more appropriate decision. This method would provide an opportunity for the mitigation of security dilemmas while still safeguarding the basic right of freedom of expression. In addition, to ban TikTok outright is to set up a risky criterion for government censorship of the internet; hence, it is an infringement of other vital freedoms. Consequently, a balanced strategy that deals with security without infringing upon fundamental values must be adopted.

Counterargument 2: Whether bans make any difference or not.

Proponents of such a ban may argue that it may not be the solution to the underlying security issues, as the users might just migrate to other apps, which can be as dangerous as Tiktok.

As a result, it is likely that a ban will not be the most effective way to solve the issue of security; instead, there should be a balance between security needs and privacy rights.

Rebuttal 2:

It is true that a ban on TikTok may not totally remove security risks, but it might still be an excellent move for dealing with them. The USA will make a clear statement to other states and tech firms about the fact that it treats citizens’ privacy and national security problems as crucial issues. Finally, the imposing of the ban can thus be very influential, not only in prompting the development of stricter regulations and oversight functions for social networking sites overall but also in enhancing cybersecurity. Thus, a prohibition may not be the perfect answer, but it is a loophole and still an effective maneuver for maintaining national security.

Conclusion

In conclusion, the decision of whether or not to outlaw TikTok in the United States is a complex and nuanced issue that touches on issues of freedom of speech and insurance data privacy.

Although there are valid security concerns regarding TikTok, banning the app entirely could have a severe negative impact on people's rights and liberties.

As an alternative, the politicians ought to support a reasonable strategy that aims to address security concerns without jeopardizing the right to free expression. One such strategy would be to implement stricter laws and oversight mechanisms that would keep an eye on the security of user information. In addition, cautious efforts must be made to engage with TikTok and ByteDance in order to improve the accountability and transparency of their data practice policies.

Furthermore, banning these apps can have unforeseen consequences, such as driving TikTok users to other sites that might also carry comparable risks. Because of this, more complex and customized policies will be required in order to satisfy democratic principles and produce stunning electoral results.

Lastly, it's important to remember that security has its boundaries and that giving up liberties should never be tolerated. State authorities may be able to reach a solution that protects both free speech and national security by carefully considering the effects of outlawing TikTok and searching for other ways to address security issues.

It is vital to strike a balance between the many opposing viewpoints surrounding the TikTok ban dispute, including those related to national security, the right to privacy, and freedom of speech. However, since TikTok violates fundamental rights to free speech, acknowledging the security risks associated with streaming the service does not warrant banning it entirely. Using a more targeted approach to address security threats without violating human rights could involve establishing stricter laws and surveillance regimes.
